THE BOSS - AUSTIN TERMS & CONDITIONS


1) Return Policy:  In Stock material that is unopened/uninstalled/unaltered in original packaging may be returned within 

(15) business days of pick up for a refund less a 10% restocking fee, unless otherwise noted.  Purchasers may opt to take 

a material credit applied to their account at a 0% restock fee if material is eligible for return and returned within (15) business 

days.  Material that is Special Order (items not stocked in-store and/or brought in from a mill/manufacturer/distributor

/warehouse for a specific customer/job) is considered Final Sale as this material cannot be returned to the point of origin.  

Material that is Closeout / Final Sale may not be returned.  Please consult with us if you have any questions before making your 

purchase.


2) Refunds: Returns will be refunded based on the original method of payment, however, cash payments in excess of

$500 will be returned via check and mailed directly to the purchaser.


3) Pick Up & Storage:  All orders must be picked up in FULL within 14 business days of purchase / material arrival.  Any 

materials left in the THE BOSS warehouse over 14 days will incur a $25/day storage fee for each day the product has not 

been picked up after 14 business days.  This incurred storage fee must be paid before the material leaves the warehouse.  

After 30 days, the material will be returned to stock to be resold and no credit will be issued to the customer.


4) Verification of Materials:  Purchaser is responsible for verifying accuracy of materials ordered against materials

quoted, purchased and received. Claims for damage or shortages must be made upon receipt of product at time of pick

up. It is the client’s responsibility to thoroughly inspect all products BEFORE installation. Any discrepancies between

the customer’s inspection and the purchased merchandise as reflected on the sales receipt must be determined prior to

leaving THE BOSS premises and a Manager must be notified. By signing for your material at time of pickup, your

signature will constitute your agreement that your order has been received in FULL and that it is ACCURATE. Once

you have left the premises, no exceptions will be made.


5) Measurements and Installations: The BOSS is not responsible for measurement or installation errors. THE BOSS

does not install material and is not responsible for installation. If THE BOSS makes an installer recommendation, it is

ultimately the customer's responsibility to determine the installer. These individuals do not work for THE BOSS and do

not represent THE BOSS. THE BOSS does not guarantee any work done by any installer.


6) Solid Wood Flooring Grading: All Solid Wood Flooring is graded by the mill to NWFA standards. There are no

grading standards for #3 material/utility grade.


7) Vehicle Loading & Transportation: THE BOSS is not liable for damage to vehicle during loading and/ or transport of

material. Clients and their contractors/sub-contractors are responsible for providing a safe and adequate vehicle for 

transportation and assume full responsibility for pickup and transportation of merchandise. As a courtesy to its customers,

THE BOSS will assist with the loading of purchased merchandise; however, it is the customers responsibility to STOP THE

BOSS employee if he/she feels that the load is too heavy for the vehicle or is not otherwise safe. THE BOSS reserves the

right to refuse and/ or cease loading service. The customer is SOLELY responsible for securing merchandise and ensuring it is

properly loaded and/or secured prior to leaving the premises. THE BOSS is not responsible for damages occurring to

vehicles while loading. If equipment or machinery is in use, the customer is required to stand at least ten feet away from

the operation of any such equipment or machinery and to otherwise exercise diligence to protect themselves from harm.

CUSTOMER ASSUMES FULL RESPONSIBILITY FOR LOADING AND/OR TRANSPORT OF MERCHANDISE AND

RELEASE THE BOSS FROM ANY LIABILITY, DAMAGES OR CLAIMS ARISING OUT OF CUSTOMER'S PICK UP

AND/ OR TRANSPORTATION OF MERCHANDISE.


8) Delivery:  If materials are delivered by THE BOSS, customers will be contacted within 24hrs of placing order to schedule delivery.  

Overtime Charge:  The quoted rate client is provided allows for a 30min MAX offload.  If client is unable to offload the ordered 

material within 30min of vehicle delivery arrival, client will be charged at a Rate of $1.75 per minute until offload is complete.  This 

fee is non-refundable and can not be credited to client account.  Missed Delivery: $99 Charge if customer is unable to receive / client 

cancels delivery after delivery is scheduled / job site is not accessible by Delivery Vehicle.  This fee is non-refundable and can not be 

credited to the client account.  Refused Delivery: $99 Charge if customer refuses delivery of some/all delivery material and the 

material must be returned to pick up location.  This fee is non-refundable and can not be credited to the client account.  The client is 

responsible for inspection of materials prior to the truck leaving the delivery location.   Once materials are unloaded and THE BOSS 

truck has left the delivery location, the client owns the material.  Claims for damage or shortage must be made upon receipt of 

product and noted on the delivery ticket and your sales representative must be contacted via email within 24hrs.
